ZitatAlles anzeigenThe Jewish Circumcision Resource Center represents Jews around the world who question circumcision and choose not to circumcise their sons.
An Israeli religious court has fined a woman for refusing to circumcise her infant son. The matter is part of an ongoing divorce case. In Israel, religious courts have authority over various family matters like marriage, divorce, and child welfare. Circumcision is viewed as a requirement among religious Jews. Israel has struggled for generations to reconcile its religious and secular traditions.
The woman has said that she does not wish to harm her son. Circumcision has been shown to result in physical, sexual, and psychological harm.
As the caretaker and mother, she has the right to forgo circumcision like thousands of other Israeli parents. No civil law requires circumcision in Israel. When parents disagree, as in this instance, the default position is to let the child decide about circumcision when he is older.
She appealed the case to the Israeli Supreme Court, a civil court, which issued a temporary injunction (restraining order), freezing the rabbinical court’s decree. The father’s response is due in the Supreme Court on January 2, 2014.
We urge you to sign this petition to ask the Israeli Supreme Court to issue its final ruling in favor of this mother’s right to protect her son.

Circumcision by default?

Ein früherer Fall, in dem eine Mutter mit dem Kind zum Christentum übertreten wollte, wurde vom Rabbi zitiert:Zitat von Attorney Rabbi Shimon Yaakobi'"Children have a right not to have their religion changed without their knowledge. Since they are still incapable of forming an opinion, it is the role of the state to protect their right not to have their religion changed, and to protect them from attempts of this kind.
In that case, the children were born and brought up as Jews. In their family and their natural environment they are surrounded by Jews. The children did not express any desire to join the mother’s sect.
Zum aktuellen Fall meinte der Rabbi:
Zitat"The minor child who is the object of this affair was born to a normal Jewish-Israeli family,” he wrote. “In their natural surroundings the couple and their children are surrounded by Jews who perform circumcisions on their sons. In a year or two the minor will attend a nursery school where he will be surrounded by children who were circumcised, and it is no secret that toddlers are capable of noticing anything unusual, and enough said."
-
In their natural surroundings

Failure to circumcise one's Jewish infant son will cause the child emotional harm by way of ostracizing him from his Jewish peers, ....

Eine Entscheidung soll voraussichtlich am 25. Februar gefällt werden.
ZitatAlles anzeigenAttorney General Yehuda Weinstein urged the High Court of Justice on Tuesday to overturn a rabbinical court ruling ordering a woman to circumcise her son.
In a brief submitted to the High Court, Weinstein said the rabbinical court had “exceeded its authority.” Moreover, he added, “it’s doubtful that the rabbinical court’s decision was based on the principle of the child’s welfare.”
The case arose out of divorce proceedings between the woman, known as Elinor, and her estranged husband. During those proceedings, conducted in the Netanya Rabbinical Court, the husband, angry over Elinor’s refusal to circumcise their son, asked the court to order her to do so.
The rabbinical court sided with the father, saying that circumcision is a religious obligation. It also ruled that for every day on which Elinor refused to circumcise her son, she would be fined 500 shekels ($142) for contempt of court. This decision was subsequently upheld by the Rabbinical Court of Appeals, which added that circumcision would also benefit the child: He will want to integrate into the society of which he is part, and in a country where most of the population is Jewish, most boys are circumcised.
In December, Elinor appealed this decision to the High Court. Via attorneys Marcella Wolfe and Avigdor Feldman, she argued that forcing her to circumcise her son constituted religious coercion and violated her right to freedom from religion. Her attorneys also raised technical arguments about whether the rabbinical court had the authority to issue such an order.
The High Court issued an interim injunction freeing her of the need to pay the fine while the case was being heard, and an expanded panel of justices is due to hear the main case on February 25.
