The focus of this paper is a Circumcision on a Children and its Justification in the criminal law. A circumcision could be justified based upon an effective consent given by the person concerned. In the case of having not a medical indication a boy is able to give his consent to a religious circumcision on him. His parents can"t also consent to the circumcision on the grounds of child’s well-being. Such circumcision can not be justifiable according to the social rules under Article 20 of Criminal Act. The surgeon who performs and parents who consent to the circumcision are punishable under § 257 Criminal Act. Thereafter a new Act is to be required.
